Eligibility |

You must be a jewelry store owner,
wholesaler or distributor to use the Jewelry Wizard. |

2. |
No Ongoing Contractual Commitment |
| |
|
|
| |
|
You are free to discontinue using the
Jewelry Wizard at any time with no penalty fees whatsoever.
We will simply bill you for any unpaid fees (ours and
eBays) accrued during the current month. |

|
| |
3. |
Monthly Billing & Statements |
| |
|
|
| |
|
Billing occurs on or about the 1st
day of each month. Itemized billing statements showing
our fees and eBays fees to you are available each month
by logging into the Jewelry Wizard website and clicking
on the "Invoices" page link. Jewelry Wizard
automatically debits your credit card for this total monthly
charge (a credit card number from you is kept on file
with Jewelry Wizard). |

4. |
Interim Billing |
| |
|
|
| |
|
At our discretion, we may at times debit your credit
card for eBay fees accrued by your account activity before
the end of month normal billing cycle. This will generally
be done only when your account begins to accrue an unusually
high amount of eBay debt within a month. |

| |
5. |
Email Communications |
| |
|
|
| |
|
When we make a sale for you, we will notify you of the
sale by sending an email to the representative you designated
when you signed up with us. Also, when an eBay member
asks a question about one of your items that we cannot
answer, we will send an email to you asking for the information.
You or your designated representative should check email
daily for possible email from us and respond immediately. |

6. |
Payment Collection for Sold Items |

|
| |
|
When an item sells, we arrange the payment to be made
directly to you. This will be either as a PayPal payment,
a credit card payment, a cashiers check or money order.
If by PayPal, the payment will be made directly to your
PayPal account. If by credit card, we will provide you
with the buyer credit card information and you will process
the transaction through your merchant account. If by check,
the payment will either be made directly to you from the
buyer, or directly to you from us. |

7. |
Client Responsibilities for Shipping
Sold Items |

| |
|
We will notify you of your sales by sending an email
to the designated contact you provided us when you signed
up. You should, therefore, check you email daily for communications
from us. |

| |
|
 |
Ship sold items to buyers promptly after receipt
of payment. |
 |
Ship items in jewelry gift box along with client
store receipt. |
 |
Receipt must include the eBay item reference number
for the sale. |
 |
Ship insured with carrier tracking number. |
 |
Notify Jewelry Wizard (by email) when item has
shipped and provide tracking number. |

8. |
eBay Returns |
| |
|
|
| |
|
You must notify Jewelry Wizard of returned
& refunded items. We will credit you our commission
fee and eBay’s related fees on our next billing
cycle to you. |

9. |
Notification of “Off-eBay”
Sold Items |
| |
|
|
| |
|
You must inform us (by email) when
a listed item has sold outside of eBay by the close of
next business day after the sale has occurred. We will
immediately end the eBay listing for the item (failure
to provide this notification to us can result in a fee
to you if an eBay customer bids on the item after it is
no longer available). |

10. |
Potential Price Adjustments to
Improve Your Sales Rate |
| |
|
|
| |
|
We will make every effort to find buyers for your items
using your initial "Starting Bid" auction prices.
Ideally, many of them will sell and some will even "bid
up" to above your initial asking price. However,
this performance is ultimately dependent on the appeal
of your particular items and how competitively you price
them. To keep your sales plan on track, we will periodically
review your sales results and may request price reduction
actions to increase your sales volume. At such time, we
will contact you to confirm your authorization to reduce
prices on your items. With your consent, we will then
reduce your Starting Bid prices and run new eBay auctions
based on the lower prices, with the goal being to raise
your sales rate. |

11. |
Independent Verification of Appraisals |
| |

|
| |
|
Clients are required to state reasonably accurate appraisal
values on item entry forms submitted to us. We may independently
review your appraisal claims to evaluate their accuracy.
If we determine that your claimed values are unsubstantiated,
we will require that you correct the appraisal values
and resubmit your items. |

12. |
Termination of Membership |

|
| |
|
At its sole discretion, Jewelry Wizard reserves the
right to terminate any clients participation with the
Jewelry Wizard service program. Upon doing so, Jewelry
Wizard will refund the client his or her original sign
up fee. |

|
| |
13. |
Disputes with Buyers |
| |
|
|
| |
|
Jewelry Wizard will use best practice
efforts to screen buyers and monitor payment transactions
to protect clients from fraudulent buyers. However, ultimately
the client bares the risk of selling through eBay. The
client assumes responsibility to resolve any disputes
arising from buyer claims over problems with purchased
merchandise . Furthermore, clients agree to indemnify
Jewelry Wizard from any financial liabilities associated
with such disputes. |

14. |
Escrow Discretion |
| |
|
|
| |
|
Although not our general practice, we have the right
to hold collected payment in escrow until after a buyer
has received a purchased item and has indicated satisfaction
with the product. |

15. |
Listing Discretion |
| |
|
|
| |
|
We have the right to deny listing items at our discretion. |
| |
